● Reflects diversity of values

What Difference Does a Judicial Selection Method Make?

What reformers say:

● Elite appointment upsets separation of powers ● Elections not liked by legal community ○ Voters not knowledgeable ○ Information restricted ○ Increased campaign spending ○ Interest group involvement ● Merit Plan good alternative

This campaign poster for a judicial candidate is especially detailed, but nowhere does it reveal his ideology or policy preferences, something you would expect in a legislative or gubernatorial poster. Judicial norms preclude such announcement of preferences; judges should assess each case based only on its facts and the relevant law. This poster only touts the candidate’s experience and education.

● Judges very homogenous group ● Elections decrease racial/ethnic diversity ● Merit Plans/appointments increase racial/ethnic diversity

business law 4 page essay any topic

The Reaction Paper. This is an essay of 4 doubled spaced typed pages reacting to a reading, a class session, or a topic relevant to materials in the class. But covering only those chapters that were on the midterm, not the material that will be on the final. You could write on assigned readings, even if we did not cover them in class (and we may not discuss all assigned readings in class). You may write on materials you glean from the media that relate to topics in the course. You may write about topics or issues in chapters of the book that we do not discuss, so long as they are assigned chapters. This is your paper; a personal reaction to something, that is, what you think about it. This is not a research paper, though you may do some research on your topic if you wish. I do not want you simply to take an area of law or topic, such as the law of contract or the CISG and explain it to me. I know what it is; you will receive no credit for such a paper. You must proof read your work. I want it in proper English. If you are unsure of your grammar etc., have someone proof read it also. I want to see how you think; how you develop a topic and how you express yourself. This is not a research paper. If you have trouble, please contact me. NOTE: THE REACTION PAPER MUST BE 4 PAGES IN LENGTH (Times New Roman font #12 double spaced), NO MORE AND NO LESS.

THE REACTION PAPER MUST BE 4 PAGES IN LENGTH (Times New Roman font #12 double spaced), NO MORE AND NO LESS. IF IT IS EITHER MORE OR LESS THAN 4 PAGES, YOU WILL RECEIVE A REDUCED GRADE.

creating an index

In this assignment you will develop an eight item index for measuring loneliness. (This will be your own newly devised measure, not one of the already established measures of loneliness.) In devising your measure, you will be working with the conceptual definition of loneliness found at the following web site: https://www.ons.gov.uk/peoplepopulationandcommunity/wellbeing/methodologies/measuringlonelinessguidanceforuseofthenationalindicatorsonsurveys (Links to an external site.)

Be sure that your items are really “on target” and actually measuring the concept defined in the link above. In addition to making up the items, I also want you to address the following items/issues:

  1. Write up a brief justification of your index’ content validity.
  2. For each item in your index, use a set of response options that allow you to achieve either the nominal or the ordinal level of measurement.
  3. Take care that your items do not encourage a response set.
  4. After presenting your index, you should include a set of “instructions” for how to calculate a total loneliness score as well as indicate any items that need to be reversed coded.
  5. Finally, tell me the level of measurement achieved in each index item (explain why) as well as the level for the entire index (explain why).

torts presentation amp outline

For this unit, watch torts in action and give an oral presentation on your findings. Go to any place of business (perhaps if you have a part-time job or an internship), or use our Lynn University campus for this assignment. Then, find FOUR potential tort issues that you see.

Next, complete a formal outline of your oral presentation, including, for each potential tort, an explanation of (1) facts and the potential injury which may occur and the specific tort which may be involved, (2) legal elements of that tort, (3) application of those elements to the facts; (4) your potential questioning of the validity of legal defenses to that tort actions.

For example, you may notice water puddling in the bathroom. Explain how a person could slip, fall and be injured. Note that injury could trigger negligence. Specify the four elements of negligence and specifically apply the elements of the tort to the facts. Complete the analysis by examining potential defenses to the tort of negligence and why that, in your opinion, would not apply. Submit that formal outline to the professor.

In class, you will present your findings in an oral presentation of 8-10 minutes, using 8-10 PowerPoint or Prezi slides. Start by completing a speaking outline for your presentation based on your findings and your formal outline. You shall be graded according to the Dialogues of Learning Oral Communication Grading Rubric, attached. This project is 15% of your grade.

Good afternoon, Ethsim,

You bring up a very important subject when dealing with the national interests of the country; domestic terrorism. Indeed as you mentioned there are now many various ways in which surveillance can be conducted for such terrorism. The big problem with domestic terrorism is the fact that it is indeed domestic, it is happening here amongst the public. Whereas the military forces conduct high levels of surveillance around the globe with able and appropriate jurisdiction for the mission, when dealing with work within the homeland, the military is extremely limited in their ability to conduct operations. Other government agencies typically take the jurisdiction however, even they are extremely limited, just as you mentioned, because of the possible infringement of privacy. The debate is everlasting with what is considered protection versus infringement but nevertheless, the military of the nation is evolving as necessary to do what they can – where they can. The military is always thriving to become a more flexible and capable opponent to all enemies when the nation gives it the power to do so. I really enjoyed what you brought to the discussion, have a good week.

Miller, J & O’Hanion, M. (October, 2019). Why we need a more modern and ready military, not a larger one. Retrieved from https://www.brookings.edu/blog/order-from-chaos/2019/10/04/why-we-need-a-more-modern-and-ready-military-not-a-larger-one/

Neoliberalism has two authors, they are Friedman and McNally. Neoliberalism is defined as a set of the idea that government need to let market alone to resolve economic problems. If the government supports neoliberalism in market, the companies have enough freedom. The company has the right to privatization, free trade and deregulation. Friedman thinks neoliberalism in market will have a positive influence because market is efficient, the government is inefficient. He thinks education, health are ‘private family service’ which can be better allocated in the market because of efficiency and freedom. As a result, neoliberalism market will give the market freedom, because no or limited state or social intervention are the most efficient way to organize the economy and to coordinate all social institutions. McNally thinks neoliberalism have a little negative effect about discipline workers. The debt is a way to discipline workers, the debt like credit card today. The company make workers owe money to the bank, Causing workers to have to work hard to repay debt. If workers don’t work hard, they will lose job and can’t repay debt. When worker can’t repay debt, bank will confiscate their house and car. For example, in ‘The Grapes of Wrath” written by Steinbeck. The farmers borrowed the money from the bank, the farmers don’t have enough money to repay loan, so bank confiscated their land.
