The need to care for the sick has been around since the beginning of time. The practice of nursing has greatly changed in that time. The matriarch of nursing, Florence Nightingale, started her influence during the Crimean War. Nightingale’s three pillars of nursing care: health promotion, disease prevention and risk reduction are still relevant today. (Whitney, 2018) During the 1800s nursing grew in the United States. Jane Delano, during World War One, started the American Red Cross of Nursing. This service utilized over 22,000 nurses at that time in the United States and overseas. During World War Two, and the baby boomer population explosion that followed, a huge need for educated nurses was created.

Nursing education has changed over time. The 3-year diploma programs, that once were so popular have all but disappeared. The associate nursing degree, pioneered by Mildred Montag, in the 1950s, as a response to an increased need for nurses, has also lost its appeal as baccalaureate nurses today are in demand. Because of the IOM recommendation that 80% of the RN workforce by the year 2020 be baccalaureate prepared it has changed the landscape of entry level nursing. (Whitney, 2018)

Advanced practice nurses are widely utilized today. The range of advance practice nurses is great including: nurse anesthetists, nurse midwives, and clinical nurse specialists. Nurse practitioners can prescribe and treat minor illnesses, nurse midwives provide low risk obstetric and gynecological care and nurse anesthetists administer more than 65% of all anesthetics. Contemporary nursing uniforms have radically changed, thank goodness. After reviewing the required reading for this week, I decided if I had to wear the “get up” from the turn of the century picture of Georgina Pope 1898, I would have picked a different profession. Professional organizations are vital to nursing practice. They represent nurses in government at the national and state level. They are a great source of information regarding new research and changes made to current nursing practice. (Helbig, 2018) Evidence-based practice is driving nursing care by substantiating what we do; professional nursing organizations disseminate this information to practioners through nursing journals and periodicals.

Professional nursing organizations are advocates for nurses. They give nurses a voice in the public eye. On Tuesday, April 16, 2019 the Washington State Senate was considering a bill, SHB 1155. This bill supports providing nurses with uninterrupted breaks (rest periods). Republican senator Maureen Walsh during the discussion of this bill stated, “I would submit to you that those (small hospital) nurses probably do get breaks. They probably play cards for a considerable amount of the day.” Walsh was trying to argue that in these rural areas nurses don’t need their uninterrupted break periods. That it is too costly to provide these rest periods in these circumstances. The professional nursing organization, The Washington State Nurses Association, immediately responded. They called Walsh’s remarks “demeaning” and said there was “zero logic” in her statements. (Stracqualursi, 2019) This is a professional nursing organization defending nursing practice both in government and in the media. This statement made by Senator Walsh created a landslide of backlash on social media. It was the swift and rapid response by the Washington State Nursing Association that was heavy hitting and reputable to combat this horrific argument made by Senator Walsh.

Professional nursing organizations are involved in government, research and education. The American Nurses Association’s (ANA) goal is to support nurses and improve health care standards. This goal is realized through membership and collaboration.

To be professionally accountable in nursing is necessary and vital for patient care and safety. According to The American Nurses Association Code of Ethics, the definition of accountability “ is to be answerable to oneself and others for one’s own actions.”
The nurse has to ensure that while delivering care, accountability is owed to themselves and the client, the client’s family, colleagues, the workplace and the profession.

An example of professional accountability is during the admission process of a client to a psychiatric unit for the first time. The client is involuntary and is not sure what this status means for them. With professional accountability, the nurse explains the involuntary status and also ensures that the family understands what this status is in a psychiatric facility. Due to the fact that the hospital is a teaching facility and nursing students are always present, each opportunity must be seen as a teaching moment, so nursing students can understand how professional accountability impacts the care of clients from the time of admission.

A senior nurse knows that establishing a therapeutic relationship allows the client to feel safe and being professionally accountable impacts both client and student especially during the assessment phase. Here the nursing process is key to clinical expertise and using the nursing process demonstrates that quality of care must start from the point of admission to discharge. This nursing process is kept in mind by a highly educated nurse who also uses evidence-based practice to deliver safe and effective care.

Evidence-based practice in professional accountability allows the nurse to have a better understanding of the practice and how accountability influences her to make decisions that fully impacts patient care.(Brower & Nemec,2017) An example of evidence-based practice in mental health is to form a client-centered plan of care to ensure all decisions are shared-decision making. The care team and the client seeking help with mental health issues come together to have client-centered care and self-directed care. 

With accountability to the client and self, the nurse is an advocate for the client and ensures that the latest evidence is used to drive change for better patient outcomes. ( Brower & Nemec, 2017).

Professional Accountability is one of the best ways for a nurse to self regulate, be conscious of the care and their impact when imparting knowledge to the future generation of nurses.

Each province in Canada sets a standard of Nursing that every nurse has to adhere by. These standards ensure that the legal and professional standards of nursing are upheld. Hence the reason a license is issued for a nurse to practice so the public can be protected and safeguarded.

In Ontario, The College of Nurse’s of Ontario is the body that sets standards and practice guidelines for nurses. The main purpose of these guidelines is to provide safe and ethical nursing care for the people of Ontario.

Practice standards:
These outline the expectation of nurse contribution to public protection.
The nurse needs to be aware of the accountability to the public.
To make the public aware of what is expected of the nurse.
These standards apply to every nurse,

In these guidelines, nurses understand their responsibilities and how to make ensure that they make safe and ethical decisions.

The other legislative body that is key to where I work is the Legislation relevant to mental health in Ontario. (RSO 1990, C.M.7-Ontario.ca).
The Mental Health Act sets out the guidelines for when a person is admitted to a specially designated psychiatric facility. The admission designation should be voluntary, involuntary or informal.
The health care consent act which states the rules determining capacity are in three areas, treatment decision, admission, and personal assistance care.
The Substitute decision Act allows for the individual who is capable to appoint another person to make decisions for them in case they become incapable.
Then there is the Health Information act of 2004. This legislation was enacted to ensure that health care providers understood the unique demands of providing mental health care for individuals and that there is no disclosure of information without the consent of the client or a substitute decision maker.
In the mental health setting, I work it is imperative to establish the status of the client immediately on arrival. Meaning if the client is voluntary, involuntary, or informal. Treatment decisions are made with this in mind. Adherence to the College of Nurses guidelines and the mental health legislation is important because depending on the capacity of the client, some immediately request a lawyer on admission who is routed through a Rights Adviser. A Rights Advisor is one of the hospital’s employees and can be reached through an extension. This information is usually posted so the client can have easy access. While trying to ensure that that client is safe and needs are met, it’s within the patient’s right to be treated immediately, and have access to an attorney. This is also a very important aspect of their lives.

In the state of Texas, “Chapter 301 of the Texas Occupations Code (TOC) contains the Nurse Practice Act (NPA) which creates the BON and defines its responsibility for regulating nursing education, licensure and practice” (Schmid). The purpose of the Board of Nursing is “to protect and promote the welfare of the people of Texas” (TBON, 2013). The Texas Board of Nursing (TBON) strives to ensure public safety by competent licensure of qualified individuals, investigation of violations and legal action when necessary. In order to achieve this TBON works closely with the Texas legislature, which meets every two years, to create bills to amend the NPA as they deem necessary (TBON, 2013). Only the Texas legislature can make changes to the NPA and in order to start the process of change, the TBON submits its proposed changes to the Texas Register, which creates a bulletin maintained by the Office of the Secretary of State and serves as a notice of state agency rulemaking (TBON,2013).

The scope of practice for registered nurses (RN) is outlined by the NPA and it sets the parameters of legal practice in accordance with federal, state, and local laws. In my area of specialty (Progressive Care Unit – step down ICU), the RN is an advocate for the patient and their family and utilizes the nursing process (assessment, diagnosis, planning, implementing, evaluating) to provide services that require specialized judgment and skill. Another large part of the RN’s scope of practice is knowing appropriate delegation. The RN accepts responsibility and demonstrates accountability in the quality of care provided to their patients (TBON, 2013). The entity I work for further adds to the scope of practice by determining which medications can be administered on our specific unit and the number of patients each RN is allowed to provide care for at any one time during a twelve-hour shift.

Standards of nursing practice provide guidance and expectations of nursing practice and nursing performance, which help define the responsibilities of the nurse. The Georgia Board of Nursing has the power to enforce the regulations as defined in the Nurse Practice Act as well as amend them if deemed necessary. The board is in charge of developing state nursing standards, license enforcement and evaluate nursing programs on a regular basis. The board also investigates any complaints against licensed nurses and imposes a disciplinary process. It has the authority to require the surrender of a nursing license during any pending action. The board’s primary purpose is to protect the public.

The Georgia Board of Nursing Nurse Practice Act recognizes that assessment, nursing diagnosis, planning, intervention, evaluation, teaching and supervision are the major responsibilities of a nurse. The steps of the nursing process include assessment, nursing diagnosis, planning, implementation, and evaluation. The Standards of Practice delineate the quality of nursing care that a patient/client should receive regardless of whether it is provided solely by a RN or by a RN in collaboration with other licensed or unlicensed personnel. My current position is in quality. These Standards ensure a responsibility and an accountability of the RN to the patient for the quality of nursing care rendered (Georgia Board of Nursing, Nurse Practice Act, Rules Chapter 410-10 Standards of Care).

In each state of the United States, there is a specific Nurse Practice Act that addresses the scope and standard of practice of nurses. Each state has a Board of Registered Nurses that governs the Nurse Practice Act, they set up rules and regulations. When these rules and regulations become established its as if they are law. (Green, 2018)

In my great state of California, the Board of Registered Nurses (BRN) consists of nine members, four members are from the general public and five are registered nurses. The five nurses have a diverse background: patient care, nursing administration, nursing education and there is one advanced practice nurse. The California BRN is responsible for implementation and enforcement of the Nursing Practice Act: the laws related to nursing education, licensure, practice, and discipline. This is designed primarily to protect the patient, not the nurse. The BRN protects patients by setting educational standards, approving California nursing programs and evaluating licensure applicants.

This has had a direct impact on the environment I work in and my practice as a nurse. The Conscious Sedation Section 2725(b)(2) of the Nursing Practice Act of California stipulates the RN providing conscious sedation will have no other role.(Conscious Sedation, 1995) In the Cathlab environment at my hospital, prior to this NPA, the RN providing conscious sedation was also the circulator in the room. The RN was expected to administer Versed and Fentanyl to sedate patients while retrieving supplies and performing other duties: sponge accounting and point of care testing. As a result of this NPA and its impact on patient safety, there are now two RN’s present in the Cathlab during procedures when conscious sedation is utilized. It also changed the matrix of the call team. There are now four people on call for emergencies, two of the call team members are RN’s. As someone who has worked in emergent situations as the only RN, I can say this is a HUGE improvement for patient safety. I applaud the California BRN and this NPA, they really do have patient safety at the forefront. Sedated patients and a potential compromised airway deserve undivided attention from an RN. This is just one example of how the standard of practice in California has been positively influenced by this governing body.

Madeleine Leininger’s cultural care theory is important for nurses to understand.The idea that as nurses we not only care for the patient but also the family and community is a significant part of this theory.It is defined, “as the focus on the analysis of different cultures to better understand their ideas of health, their behaviors, and their thoughts” (Grand Canyon University, 2018). A patient’s culture plays a significant role in how they perceive nurses, hospitals, and the health care system itself.“Native Americans are at a greater risk than whites for poorer overall physical and mental health” (Roh et al., 2015, p. 970).Historically, native Americans have experienced great loss in regards to their people, land and culture by the dominant European culture (Roh, et al., 2015).A patient that presents with mental health issues may have a problem discussing feelings of depression or anxiety with anyone outside of their culture.This is vital for nurses to understand. Nurses need to be aware of significant cultural aspects that can affect a patient’s overall health and treatment.Applying Leininger’s cultural care theory in the nursing process will help ensure a treatment plan that will improve the possibility of a positive patient outcome.
