Leininger’s theory or the Culture Care theory, involves knowing and understanding cultural differences in the area of Nursing care practice. Her theory emphasizes that different cultures requires different but effective care. This knowledge provides culturally specific meanings and expression in relation to care and health. Without this theory an array of ineffective care can easily be presented.
For example; A patient’s diet can be of great significance in their care. Not having thoroughly thought out culturally appropriate meals prepared for the sick can ultimately change the trajectory of how effective an outcome will be. Culturally competent nursing care helps ensure patient satisfaction an positive outcomes.
Every race or culture may perceive or demonstrate the effect of pain differently. She developed a theory and research method designed to guide nurses to (a) understand cultural similarities and differences in how people care for themselves and others during health, illness, disability, dying, and death, and (b) provide culturally congruent, competent, and sensitive care. Wehbe-Alamah, Hilba B) Leininger’s Culture Care Diversity and Universality Theory: Classic and New Contributions. As written in The Parents’ Cultural Care Towards Promoting Child Development; A quantitative approach that was carried out with parents of children below five years old, who were registered in a healthcare service from Picos city, Piaui State, Brazil.
Nurses are expected to explore even more the probable performance according to each child’s age and considering the child development stage, moreover, respecting the cultural care provided by their parents.
The conception model was designed to guide Nursing practice therefore, Without understanding one’s culture, the risks of inadequate care arises. Conceptual modes are important in guiding the development of the discipline of nursing. Studies continue to show that patient satisfaction scores especially in the Hospital environment grossly increases when close attention and consideration is give to the Patient’s culture an their ways of life.
Leiniger’s model provides three action modes nurses can use to help bridge care and provide care to someone with respect to their individual beliefs, cultural background, and values.
These modes are all used today in a variety of clinical settings.

Health as a Human Right
Article 25 of the 1948 UDHR and the Constitution of WHO are examples of positive expressions of health as a human right.

Your research should also include answers to the following questions:
- Analyze the purpose of Article 25 of the 1948 UDHR and the Constitution of the WHO.
- In your opinion, do these two positive laws contradict the no-duty principle in the United States? Why or why not?
- The term “the right to make informed health care decisions” is an important health care right of patients that have the right to make informed decisions about the direction of their care, including refusing treatment. Give your views on this statement and support your answer using relevant references.
- Compare and contrast the terms “the right to make informed health care decisions” and “the right to health.”

After answering the above questions, read the following statement:

Evidence based practice are the base standards in which we base all our nursing practices on. They are methods, experiments, hypothesis that have been tried and true, and proven to be the most effective in standard nursing care. In nursing, critical thinking has been defined as the ability to use in professional actions the highest cognitive abilities, such as to analyze, to question, to evaluate, to conceptualize, comprehending individual and collective health problems in a more precise, logical and appropriate way. These skills directly implicate the achievement of adequate outcomes through effective clinical judgment and clinical decision-making (Costa et. al, 2019). This is important to healthcare and nursing in general because, daily we are made to think about and make decisions regarding healthcare and being responsible for other people’s lives. In doing so, we can’t just make decisions. We need to sit down and critically think about all that we are doing and how our decisions could be affecting the patients’ outcome. When we use evidence-based practice as well, we’re taking something that has been tried and proven to be effective to better take care of our patients. Using evidence-based practice and critical thinking in taking care of our patients sets the standards for what they are needing, and what we should all be trying to exceed in doing.
Comment
Evidence-based Practice is defined as “an integration of the evidence available, nursing expertise, and the values and preferences of the individuals, families and communities who are served.” Other Organizations defines EBP as “a continuous interactive process involving the precise, careful, thorough and judicious consideration of the best available evidence to provide care. “ Evidence-based practice supports nursing care and can contribute positively to patients and family outcomes. EBP Supports nursing care that can be “individualized to patient and their families, is more effective, streamlined, dynamic and maximizes effects of clinical judgement. All in all, these definitions are quite evident in that the focus is primarily on the best ways to find and apply research evidence. Hence, the need for EBP will always remain a constant driving force in nursing and healthcare as a whole.

In 2006, a Virginia high court held that a brutal assault on a disabled patient is governed by tort law and not by the state’s Medical Malpractice Act. In this assignment, you will analyze this case and identify the scope of medical malpractice and tort law.
The Case
Alcoy was 79 years old when she suffered a stroke that left her physically helpless and mentally damaged. She was moved to a nursing home. Four days later, she was brutally assaulted sexually; the assailant was never identified. Alcoy died several months later. Her estate administrator sued the nursing home for negligence and assault. The nursing home responded that the case was governed by the state’s Medical Malpractice Act, and that Act controlled the extent of the nursing home’s liability. The district court held in favor of the nursing home; the administrator appealed. Virginia high court held that the case is governed by tort law and not by the state’s Medical Malpractice Act (Alcoy v. Valley Nursing Homes, 2006).
Reference:
Alcoy v. Valley Nursing Homes, Inc., 272 S. E.2d 301 (Sup. Ct., Va. 2006).
Analyze the scenario and respond to the following questions:
- Why did the state change the case from medical malpractice to tort law?
- Do you agree with the state’s decision? Why or why not?
Compile your analysis in a 3-to-5-page Word document.
