The CAC is supposed to decide on the matter within a fixed time period by taking into account the merits of the case and the percentage of employees being represented by the union. Representation of at least 10 percent of the total workforce is once such criterion which helps in deciding in favour of the union.

Step-4: Once the bargaining unit is formed the union is granted recognition either directly or by carrying out a referendum amongst the workers to ascertain the validity of the claims being made by the union.
